It’s All the Rage, Street Artists Filing Lawsuits Left and Right

In what could be charitably described as a sign that Street Art has entered a new phase of cultural acceptance and appropriation, some creators of art in the public sphere are attempting to lay legal claim to the profit-making that they didn’t necessarily sign on to. In just the last few months a handful of artists from New York, Los Angeles, and Buenos Aires have discovered their murals have been used in fashion, music, and cinema to great effect, but sadly, they say, without their knowledge or permission.

Of course this sort of inspiration/appropriation has been going on for years – if you want to meet models on the sidewalk just move to Bushwick, Brooklyn and you’ll probably accidentally end up in a fashion spread yourself. Here is where countless fashion shoots, video shoots, movie scenes all happen continuously and money is exchanging hands to make it happen – just not for the artists. Usually they are essentially unpaid, uncredited backdrop artists for the edgy “street” fantasies of stylists.

The courts ultimately will have to decide the relevance of these recent claims but the topic does raise fascinating questions about public space, intellectual property, copyright, and the reasonable expectations of the artists once their work is set free into the streets.  In these cases the artists had permission and encouragement to create their works and perhaps thousands of images of the works are in existence since the work is made public. The concern here is raised once those images are privatized or pass into the purely commercial world of selling product.

More interesting will be to see if these lawsuits will extend in the future to include the unsanctioned, un-permissioned, acts of vandalism that appear on private property as well. Will artists seek protection from a legal system they actively transgressed? Can the pieces of art placed illegally be re-claimed by the artist when the work is found printed on a lycra bodysuit or embossed on a wallet? If so, how will the artist claim ownership?

Here are just three recent examples of lawsuits reportedly being filed by artists laying claim to the benefits of their work.

Maya Hayuk

Street Artist and fine artist Maya Hiyuk is reportedly suing pop star Sara Bareilles, Sony, and Coach for using her Houston Street wall in New York as a back drop to sell their products.

Revok, Reyes and Steel

MSK crew members Revok, Reyes and Steel have filed a claim saying that designer Roberto Cavalli was a little more than just inspired by their collaborative mural in San Francisco when designing a line for his “Graffiti Girls” collection sold through the website. A quick Google search shows that the line extends to clothing, accessories, sneakers, even a phone case and is sold at stores like Nordstom, Neiman Marcus, and online giant Amazon.

Worse, says the claim, “Sometimes, Cavalli added what appears to be a signature, creating the false impression that Roberto Cavalli himself was the artist.”

Jaz, Ever, and Other (aka Troy Lovegates)

Street Artists and muralists Jaz, Ever, and Other are suing for copyright infringement because the newest Terry Gilliam (Twelve Monkeys, Brazil) film The Zero Theorem allegedly featured a mural that looks startlingly similar to one they painted together in Buenos Aires about four years ago.

You can actually still see a number of stills from it it on The Zero Theorem Facebook page right now if you like.

Artistic Routes Through and with Public Spaces

The month long 4th Edition of Bien Urbain just wrapped in Besançon, France and the results are predictably rather awesome due to the quality of the work, the site selections, and the integrated nature of the entire presentation. “It is not about designing an open-air art gallery or about decorating the town,” say the organizers, and maybe that is why each artist seems to consider the whole before devising his or her addition to it.

BSA has been tracking Bien Urbain since its introduction and each time the collection of artists is thoughtfully selected, with each helping to define and refine the measure of public art without the trite pleasantries of commercially sponsored festivals nor stultifyingly bland results of design by municipal committee.

Whether purely modernist (MOMO), cerebral (Brad Downey) or poetic (Pastel), the contributions to Bien Urbain are more edifying than edifice and enable one to experience “artistic routes through and with public spaces,” as the festivals’ motto intones.

The Williamsburg Industrial Park, sometimes referred to as East Williamsburg, has been known for light manufacturing industry such as food processing, furniture making, packing/shipping of dry goods, warehousing – and of course it has played host to a growing number of artists studios in the mix. Of course it has been impacted by the ballooning interest in Bushwick and Williamsburg and all-things-Brooklyn in general but for some reason this still feels fresh and unjaded. Because you don’t have to worry too much about nervous neighborhoody types it has also been a welcoming environment for musicians to rehearse and artists to experiment.

The doors of cafes, live music venues, scattered galleries and performance spaces have opened in the last couple of years and a growing number of legal murals alongside an occasionally lively graffiti / Street Art scene has been cropping up and out. As is the case with new bohemia and a heady mix of hormones/entrepreneurship/euphoria/good weed, some of these dreams will take off and grow while others will fade into the lore of an experimenting NY scene that proudly cuts a notch with a pen knife into the cultural timeline. The best idea is always to jump in and be a part of it right now and enjoy it to its fullest. But that’s just us.

A music and mural art festival called “Juicy Art” saw its first edition this past weekend and the transformation continues with entire blocks getting smashed by a mix of independently produced work, unsanctioned guerilla pieces, and naturally, murals. Take a look at this survey of a popping scene captured by photographer Jaime Rojo in the last couple of weeks.

The Power of Color via Street Art, Graffiti, and Murals

No doubt it is the grey days of late winter that is making us think about this as we brace for the next snowstorm, but today we’re considering the impact that Street Art color has on architecture that never asked for it.

We’re not the first to think of hues, shades, tones, and palettes when it comes to the man made environment of course, but it does strike us that most of the buildings that are hit up by street art and murals today were designed by architects who never imagined art on their facade.

Modern architecture for some reason is still primarily grey, washed out greens, beige, eggshell, snore.

“Color is something that architects are usually afraid of,” said internationally known and awarded architect Benedetta Tagliabue in an interview last May about the topic of color.  A generalization probably, and you can always find exceptions of colorfully painted neighborhoods globally like the Haight in San Francisco, La Boca in Buenos Aires, Portafino in Italy, Guanajuato in Mexico, Bo-Kaap in Capetown, the favelas of Rio de Janeiro and the Blue City of India, but many of those examples speak to color blocking and pattern.

We’ve been looking at the power of Street Art to reface, re-contextualize, re-energize, and re-imagine a building and its place in the neighborhood. Some times it is successful, other times it may produce a light vertigo. The impact of work on buildings by today’s Street Artists and muralists depends not only on content and composition but largely on the palette they have chosen. It sounds trite, and self-evident perhaps, but much of Street Art is about color, and primarily on the warm scale first described by Faber Birren with his OSHA colors and color circle in the 1930s .

Birren developed his color system with the observation that artists favor the warm colors more than the cold, from the violet side of red and extending beyond yellow because “, their effect is more dynamic and intense and because the eye can, in fact, distinguish more warm colors than cold.

It’s common now to think of 21st century Street Art as the graffiti-influenced practice that primarily activates the detritus of the abandoned industrial sector blighting western cities in the wake of trade agreements that sent all the jobs to lands without protections and regulations. While that is definitely the sort of neglected factory architecture preferred for “activation” by many graffiti artists and Street Artists alike, we also see more curious couplings of color with the delicately ornate, the regal, or even modernist structures today thanks to artists being invited, rather than chased.

The results? Abstractionist, cubist, geometric, letter-based, illustrative, figurative, text-based, outsider, folk, dadaist, pop.  One common denominator: color.

“The environment and its colors are perceived, and the brain processes and judges what it perceives on an objective and subjective basis. Psychological influence, communication, information, and effects on the psyche are aspects of our perceptual judgment processes,” writes Frank H. Mahnke in his recent piece for Archinect. The author of Color, Environment, & Human Response has made it his mission to explore psychological, biological effects of color and light and to help creators of the man-made environment make good choices.

Whether all of these choices are good, we leave up to you. But it is worth considering that Street Artists have been part of the conversation on the street for decades now, making powerful suggestions to architects and city planners , so maybe it’s worth taking another look at what they’ve been up to lately.

Welcome! Now Go Home! That’s what Tony Carapachio at the corner deli used to say about all the foreigners moving into the neighborhood. Sounds like a lot of the comments being directed at Banksy by locals, although their voices are primarily drowned out by clicking iPhones.

The pie is big enough for everybody, and in a city where 176 languages are spoken by kids in our schools, we can probably handle new voices on the street. Our Banksy-related favorite development this week was the small pack of entrepreneurs who were selling access to his stencil on a wall in East New Yawk for $20 a pop. Nice! They’re not the first or the last who will endeavor to profit from his work.

Also this week came the definitive news that 5 Ptz in Queens will be razed in favor of a new condo development. It is privately owned and has transformed into a graffiti holy place over the last decade and a half, and while you could see the final outcome being something like this, many had held out hope that it would be preserved or saved by a rich Robin Hood sort of character – like Jay Z or even Banksy.

You may remember our photo essay from earlier in the summer about 5 Ptz.  The good news is that they say the new space will set aside 10,000 square feet for graffiti.

ROA Diary : New Work from Australia, Argentina, Brazil, and Panama

“I felt an intimacy with them…bordering on frenzy [that] must accompany my steps through life,” said the celebrated John James Audubon, the French-American naturalist and painter more than 200 years ago of his deep love for birds that began as a teenager and lead to his illustrations of the still revered book The Birds of America. By now we may consider the Belgian artist named ROA to be an Audubon of the Streets, so committed he is to documenting by hand and sharing with the public his studies of the animal world on walls, especially those that are often overlooked or dismissed as pests.

As we have tracked the aerosol orinthologist and urban naturalist for you during his travels of the last few years, his dedication to showcasing the oft-marginalized creatures of towns, cities, and regions around the world has not waned. Like Audubon, his depictions have become progressively more accurate in detail and now give a greater  sense of mass, texture, and the presence of the subject.

Today we bring you new unpublished photos from some of his recent travels to Australia, Argentina, Brazil, Panama, along with some insights from ROA about some of the animals he has come in contact with. Not only do we not recognize a number of them, we also probably haven’t seen their skeletons or musculature, which the artist sometimes peels the skin off of for us to inspect.

As a body of work ROA’s mounting collection of birds and rodents must be nearing a hundred or so around the world, yet he continues to unveil more. As ROA told BSA a few years ago, “I like rodents. Birds and rodents. Without having made a choice, I feel really good painting birds and rodents.”  We are very happy to bring you these newest birds and rodents for you to enjoy.

MELBOURNE, AUSTRALIA:

“This past November I was invited to Melbourne for my solo show ‘Carrion’ in the Backwoods Gallery. The installation I built for the show was inspired by the numerous amount of roadkill that there is on the Australian continent. During my stay I painted a few days in the Healesville Sanctuary which specializes in rescuing and recovering native Australian animals and conducts breeding programs for almost-extinguished species. The sanctuary adopted a litter of orphaned marsupial babies found in the pouch of a mother who had been hit by a car.”

One morning after a storm as I walked to the gallery through a park I found a dead bat. When I looked under its wings I also discovered a living baby, which I helped to rescue and it is doing fine.

Here you can see that I painted an echidna (first image), an egg-laying mammal that I had spotted a few days earlier while in a car driving in Tasmania.

The skeleton images are of a wombat, a marsupial that often is hit by cars in Victoria and should always be observed after finding it to assure that there is not a living baby left in the pouch who needs to be rescued”

BUENOS AIRES, ARGENTINA

After his visit to Melbourne, ROA traveled to Argentina where he was hosted and entertained by EVER and who showed him a great time for the New Year’s holiday in Buenos Aires.  They also each did a new piece side by side while he was there.

“I painted a Serenia (sea cow) paradoxically also a ‘cow’. It’s a native (Patagonia) sea mammal and an herbavour,”says ROA. According to online sources Brazil outlawed hunting of sea cows (or manatees) in 1973.

Reminding you of the animal-as-food connection, ROA completed this partially skinned bull on the terrace of his friends place at the Post Bar and ‘Hollywood in Cambodia Gallery‘. “Maybe is is a sort of ‘Memento Mori’ in this beef and BBQ country,” he jests in a half-serious wisecrack

São Paulo, BRAZIL

ROA brought four new friends along to his first visit to São Paulo, a city that he has wanted to visit for a long time. “In March I stayed there a month and it was like a dream that finally came true. I loved it,” he says of the visit that was hosted by the people from Mathilda Cultural, who showed him around the city. Included in the walls were a bird, an anteater, an anteater, and the largest rodent in the world a capybara.

After Brazil, ROA visited Panama City at the invitation of the first Bienal Del Sur Panama 2013, a huge cultural festival that celebrated the 500th year of the discovery of the South Sea.

Wall \ Therapy 2013 Friday Update 07.26.13

Skunk in the tunnel. ROA is back in Rochester.

But he’s not alone – a number of new artists arrived mid week to get the aerosol festivities reinvigorated. Not that they were flagging.

WALL\THERAPY has been up on a record number of walls all week – a rolling panoply of artists and organizers and volunteers and paint and sandwiches and water bottles and cherry pickers and neighbors stopping to watch and ask questions, offer opinions, and send it out on Instagram. Wednesday night was a meet and greet and panel talk with some of the artists and last night was a full on party at a local club. The wide variety of installations is providing entry for a lot of conversations online and in the street about the art and the artists – which is always good for building engagement with public space.

Here are new process photos from the last couple of days from Binho, Cern, Chris Stain, DALeast, Ever, Faith47, Gaia, Mr. Prvrt, Range, ROA, Siloette, Thieven Stephen, and Wise2.

Chris Stain got started earlier in the week and didn’t really like his original piece, so he regathered his ideas to do this brand new piece derived from a photo he took of his son Kesh this spring. Combining an urban cityscape from Queens with the portrait, Chris explains, “Lately I’ve been inspired by double exposure photography and I wanted to explore those possibilities in my own work.”

WALL\THERAPY 2013 Daily Checkup and Scan of Founder Ian Wilson

WALL\THERAPY began in earnest this weekend with a Friday kickoff party that welcomed arriving artists and the local community together and then jumped directly into the making of art with many murals going up on walls around town in Rochester simultaneously Saturday and Sunday. The dual pronged focus of WALL\THERAPY is a mural festival that draws Street Artists and graffiti artists from around the world to work alongside local artists and to raise awareness of people’s access to medical technology.

Street Art and medicine; You may wonder how the two are related, and the answer is that these are two of Ian Wilson’s greatest passions. A Brooklyn born graff writer who went on to pursue a career in teleradiology, Ian works long doctors hours at his regular gig in a local hospital and puts this WALL\THERAPY event together with partners, volunteers, and community members. Finally, he is working to bring imaging and diagnostic equipment to communities around the world who don’t have this basic tool to treat disease.

Since BSA supports people who actually give back, we are very happy to be the Media Partner for WALL\THERAPY and are proud of the artists who are lending their talents to this initiative in this northwestern town of New York State.

Graffitimundo Presents: “The Talking Walls Of Buenos Aires” (Washington, DC)

Graffitimundo
Graffitimundo presents the group exhibition “The Talking Walls of Buenos Aires”. Opening Saturday, July 13th at The Fridge in Washington DC. This will be the first time Argentina’s unique urban art culture has been presented in the US.

Urban art in Buenos Aires reflects the city’s turbulent history and rich cultural heritage. Throughout the last century the city walls have been extensively painted by artists, activists, political groups and the public and have become an established and dynamic channel for expression.

During the last two decades several different artistic styles have developed. The devastating Argentine economic crisis of 2001 created a generation of young artists determined to take to the streets and reclaim their city. As they collaborated in a spirit of solidarity a new and distinctive visual language began to emerge.

“The Talking Walls of Buenos Aires” features mural art and original artworks from leading Argentine artists and art collectives, as well as video works and historical and contemporary photography portraying the urban landscape of Buenos Aires and seminal moments in the country’s history.

The exhibition celebrates a form of expression rooted in activism and a desire to transform public space, and in the process challenges conventional views on what graffiti is, what street art represents, who creates it, and why.

EVER, Immigrants, and the Eagles Wings in Chicago

Street Artist “Ever” spread his wings in Chicago last week to radiate his kaleidoscopic vision of the immigrant multitudes across a huge expanse of wall in the Pilsen neighborhood.  Just outside the University Station Condominium, one the neighborhoods most diversely populated, this inclusionary vision of the American eagle refers directly to the experiences of the immigrant community who negotiate themselves through the obstacles and opportunities inherent in moving from one country to another. Says Nick Marzullo of Pawn Works, Ever “had a blast as he was getting quite a lot of positive attention and press while here in Chicago.”

Street Artist EVER was in Cleveland with Nick Marzullo from Pawn Works as Nick visited his hometown neighborhood of Collinwood a few weeks ago. While there the native Argentinian did this huge colorful and compelling mural in his surrealist style – perhaps it is a scene depicting a master of industry controlling the tools of technology while a mass of workers is in tumult below him.  But just what does he see with those blue streams flowing from his eyes? Whatever the backstory is for his works, the talent and imagination are clear wherEVER he goes.
